Northern California Property Problem Guide
Can You Sell a House With Liens or Judgments in California?
Yes, a California property with liens can often be sold, but valid liens affecting the property usually must be paid, released, negotiated, or otherwise resolved so the buyer can receive acceptable title. The first step is determining exactly which liens attach to the property and their current payoff or release requirements.
The short version
- Mortgage or deed of trust
- Property tax lien
- Judgment lien
- HOA lien
- Contractor or mechanic's lien
- Old lien that may already have been paid
Common questions
Can liens be paid from the sale proceeds?
Often yes. Many routine liens, loans, taxes, and closing obligations are paid through escrow from sale proceeds if there is enough equity and the lienholder provides acceptable payoff information.
What if the liens are more than the property is worth?
That can require lender or lienholder approval, negotiation, additional funds, a short sale, bankruptcy-related analysis, or another legal strategy. It is not a normal equity sale.
What if an old lien was already paid?
If a paid lien was never formally released, documentation may be needed to obtain and record a release or otherwise satisfy the title company.
